You have the right to emergency care, even if you owe money

If you are worried about unpaid hospital bills, it is important to know that you have a legal right to emergency medical care. This right comes from a federal law called the Emergency Medical Treatment and Labor Act (EMTALA). It protects everyone, even people without insurance or with past medical debt.

What this means for you:

  • Hospitals must treat you in a medical emergency, even if you have unpaid bills,
  • They cannot delay care to ask for payment, and
  • You cannot be turned away from the emergency room because of debt.

Still getting bills after care?

Hospitals can still send you a bill after care. But they cannot use past debt to deny future emergency care. If you get a bill you cannot afford, you may be able to get financial help. This is more likely if the hospital is a nonprofit.
